European Law the Ordinary Legislative Procedure

n European Law the Ordinary legislative procedure is used when drafting hard law to ensure that the democratically elected representatives of the EU citizens have an equal say in appropriate areas of law making. There will be a brief analyse of the Ordinary legislative procedure and a discussion on it. European Law is very complex law , within EU law there is various different treaties which are in place. Two most significant treaties which have importance to the legislative process are The Treaty on European Union and the Treaty on the functioning of the European Union.The Treaty on European Union also known as the Maastricht Treaty was signed in Maastricht 7th of February 1992 and the Treaty on the functioning of the European Union also was known as the treaty of Rome until the Treaty of Lisbon came Enforce and changed it’s name , the original Treaty of Rome was signed in 25 March 1957. These two treaties have effect on the constitute of the Union , and in effect these two d ocuments had all ready created a Federal State which was recognised by the European Court of Justice this was before the Treaty of Lisbon as put in place.Within EU there are two types of Legislation Primary and Secondary. Primary legislation is the ground rules or basis which is set out in the treaties. Secondary Legislation includes regulations, directives and decisions these are derived from the principles and objectives set out in the treaties . The EU’s standard decision-making procedure is known as ‘co-decision'. This means that the directly elected European Parliament has to approve EU legislation together with the Council.The TEU established the co-decision procedure , this provided the European Parliament with new powers of amendment and right to reject legislation. This procedure was carried on through out all the treaties , however the Treaty of Lisbon renamed the co-decision procedure to the ordinary Legislative procedure. The ordinary Legislative procedure i s highlighted in article 294 of the TFEU. The ordinary Legislative Procedure must be applied wherever the legal base provides that an act shall be adopted â€Å" in accordance with the ordinary legislative procedure† (art 294 (1) TFEU. The procedure begins with the commission submitting a proposal to the European Parliament and the council. The commission also take into account since the treaty of Lisbon they must also propose this forward to the national parliaments this can be seen in protocol 1 and 2 of the TEU. The next stage is the first reading and normally the first reading is by the European parliament. First Reading The parliament decides whether or not to view the proposal which was made by the commission , the parliament then contacts the council and tells them its view of the proposal.Then there are two possibilities which can arise: If the council approves the Parliament’s position , the council , acting by qualified majority , shall adopt the act concerne d . The wording of the act will correspond to the position of the parliament ( art 294(4) TFEU);. If the Council does not approve the Parliament’s position , the Council , acting by a qualified majority ; shall adopt its position and communicate its position to the parliament and communicate its position to the parliament (art 294(5) TFEU. The Council shall inform the Parliament fully of the reasons why it adopted its own position at first reading (art 294(6 TFEU). This will obviously include reasons as to why the council has rejected the Parliament’s position. The commission shall also inform the Parliament fully of its position (art 294(6) TFEU). The first reading of legislation is very length and time consuming. When the council disapproves of the legislation instead of going straight to the commission who projected the future piece of legislation they report back to the Parliament then vice versa .This is making this process very complex as instead of doing two ste ps this could be easily completed in one ,the Council could just report back to the commission and this would make this process so much more effective This would also allow the hard law to be implemented quickly so they can take direct effect within the EU. Second Reading The Parliament has three months from their first initial contact with the council about the commissions proposal for legislation if they have not came to a decision whether or not to carry on with the proposed legislation or agree with the Councils view on it .Then the council will be deemed to adopt the act in accordance with its position Art 294(7)(a) TFEU. The Parliament can take different approaches within the three month timeframe. The Parliament can reject the Council’s perception if they do so then the act would be considered not to have been implemented. This is known as veto and prevents the bill becoming law. However in order for this procedure to take place there must be a majority vote of the com ponent members of parliament.Or they can vote an majority vote to propose the amendments of the future legislation which the council has proposed. In my opinion I think that it is beneficial that the parliament can chose to make the law veto as personally the parliament members are for the citizens of the European Union therefore as they have the power of veto then they can ensure fair and effective legislation is introduced into Europe and not just any old law which is only really benefiting members of the Council.Although in order to make the law veto there must be a majority which I personally don’t think its fair as alias are likely to stick together ie France, Germany etc normally side with each other these major European countries hold the most power in central Europe therefore this can have an major effect on the smaller countries like Malta. The smaller countries may be forced to implement law which they did not agree to , but due to the majority vote it will have to be implemented or the proposed piece of legislation which would benefit them significantly may be rejected.Once the parliament amends the piece of legislation it then has to be agreed by the European parliament members, the amendments are then sent to both the Council and the Commission. The Commission then looks over the draft piece of legislation and looks particularly at the amendments and they liaise with the parliament giving their opinion of the amendments which the parliament made. The Council has a different role in regards to the amendments.They Council does not give there opinion but merely can reject all amendments , accept all amendments , or accept some amendments and reject others. This stage is unnecessary personally because the commission has all ready give their opinion of the legislation as they came up with the idea to create the legislation and generally have a outline of what the legislation should consist of , although it does have its Also the Council has also gave their own opinion in the first reading.The Parliament has a huge work load because of this as they are continuingly asking for opinions and are constantly having to change the draft to suit the Council and Commission. This can have a huge effect to the hard law within Europe as countries can choose to opt out of specific pieces of legislation , as the Council , EP and the Commission would be continuously back and forth with opinions trying to make the law suit every member state.For example when the Treaty of Lisbon was first introduced Ireland refused to sign it and because of this it resulted in a second referendum being conducted in 2009. Also Czech Republic negotiated an opt-out from the Charter of Fundamental Rights of the European Union. Personally in my own opinion this is not fair allowing countries to opt out of certain pieces of legislation or treaties. This defeats the purpose of the EU being established. The European Union was created to ensure fairness , equality and satiability within Europe and try to unite Europe as one.Allowing countries to opt out is not creating a fair and equal Europe it is simply just allowing member states to do things their own way to suit themselves. Generally I believe that the majority of EU members do not take the time and consideration to review the law that is being presented to them and how this could actually benefit or effect the citizens that they are suppose to be representing at times I feel members of the EP , Commission and the Council only think about themselves and how it could effect them not the citizens.The Council must act within 3 months of receiving the amendments from the parliament. The council approves all the amendments of the Parliament acting;(i)by a qualified majority if the Commission has also accepted all the amendments; (ii) by unanimity if the commission has rejected all the amendments or (iii) by a mixture of the two if the Commission has accepted some (qualified majority) an rejec ted others (unanimity) in this case the act is deemed to have been adopted (art 294(8)(a) and 294 (9) TFEU)If the Council does not want to approve all the change in the act , then in this case the President of the Council and the President of the European Parliament must liaise with each other and come to an agreement and conduct a meeting of the Conciliation Committee within the six week time period. This is highlighted I ( art 294(8)(b) TFEU) Conciliation Committee The conciliation committee of an equal amount of members from the council and also an equal amount of members from the European parliament.There aim is to agree on the draft piece of legislation which was conducted , within the second reading and come to an agreement of how the legislation should be written. However there must be a majority vote of both the EP and Council members. The commission also takes part in the discussions and â€Å" shall take all necessary initiatives with a view to reconciling the positions o f the European Parliament and the Council† After the meeting with the Conciliation Committee there are two possibilities which could occur: The EP and Council can agree with the joint test and then the act Would be deemed to be adoptedHowever a third reading of the act may be required this is seen in Article 294 (13) & (14) TFEU. In this article it explains what the third reading consists of , according to the article it states â€Å" if , within that period , Conciliation Committee approves a joint text , the European Parliament , acting by majority of the votes cast , and the Council, acting by a qualified majority , shall each have a period of six weeks from that approval in which to adopt the act in question in accordance with the joint ext. If they fail to do so, the proposed act shall been deemed not to be adopted. Section 14 relates to the time frame the EP and Council has ; â€Å" The period of three months and six weeks referred to in this Article shall be extended by a maximum of one month and two weeks respectively at the initiative of European Parliament or the Council. This third reading yet again is simply another procedure which is not required although if both the EP and the Council cannot agree , where do you go from there? Personally I think there should be more stricter rules when creating legislation , especially when the council needs a majority vote , this is making the process a more lengthy procedure as the Council may be agreeing to adopt the law but because there is no a majority vote it has to go for a further reading. The ordinary legislation suggests in its integrity suggests a common procedure however this is not the case this , procedure is very complex and time consuming. Generally I feel this process contradicts it’s self completely.The European Parliament is demanding more powers from the Council but the Council is not willing to accept these demands. However it is made apparent in article 296 TFEU that the Parl iament can choose to make the law veto , but cannot demand for the amendments they have made to the draft to be accepted. Therefore the Parliament must either accept or reject the amendments , which completely defeats the purpose of common procedure . Once the EP makes the law veto the its back to square one again.To conclude personally I feel that the ordinary legislation procedure for European Law is very complex and contradicts its self in so many ways. Therefore I do not think it is a very effective way to create hard law as the parliament can choose to make the law veto however cannot reject all amendments , is this not just making the law negative ? Manners are constantly changing from one century or one generation to the next. For example, a handshake originally was meant to show that men were not carrying a sword or dagger in their hands. Men still tip their hats because once knights in armor lifted the visors of their helmets to show their faces. And it wasn't too many years ago that a man almost always got up in a crowded bus and gave his seat to a woman. Nevertheless, certain manners do survive from one decade to the next, and this is because manners make life easier for everybody. There are three important ideas behind the good manners we use today: custom, consideration, and common sense. Custom is the habit of doing certain things like shaking hands and tipping hats mentioned above. Consideration is the most important idea behind all good manners. Almost always, being considerate is being well-mannered. Consideration is simply thinking about the way the other person feels. Being rude to someone are bad manners, not because a book says so, but because it causes hurt feelings. Nearly all good manners have in element of common sense. If you are standing in the rear of a crowded elevator, it's neither reasonable-nor good manners-to try pushing your way to the front so you can get out first. These are the basic ideas we want to teach our children when we are trying to instill good manners-simple kindness, consideration, and common sense.   The following suggestions written for and directed to children may give some added authority in the matter of what is common courtesy and what is not. Manners at Home Home is where you learn to get along with people. ‘Me closer you live with other people, the more important good manners are. Everybody in a household should respect the rights and feelings of everybody else. Try to listen when others in the family have something to say. Even a little brother or sister who can't yet read or a grandmother who seems quite old has a right to an opinion. It is important for members of a family to consider each other's privacy. No matter how crowded a home is, everyone in it has a right to some place that is his own. Here are some privacy don'ts: Don't open a closed door until you have knocked and waited for permission to enter. Don't go into anyone else's bureau, desk, box, or papers at home or anywhere else without his permission. Don't read anyone's mail or anything he has written (for example, a diary) unless he asks you to. Don't discuss the private affairs of your family with outsiders or tell about a family problem. Another important part of family good manners is sharing. You share the TV set and the telephone and the bathroom and maybe a bedroom or a closet or a desk. You share the work. This means cleaning up after you and sharing the responsibility for the safety of everyone in the house. Telephone Manners Always give the person you are calling plenty of time to get to the phone before you hang up. If the person who answers is not the one you want, give your name and ask if you may speak to the person you've called. Ask, â€Å"May I speak to Tommy?† not â€Å"Is Tommy home!† If he isn't in, you may leave a message. If someone dials your number accidentally, accept his apology. Everyone sometimes dials a wrong number. No one intends to. If you accidentally dial a wrong number, excuse yourself. It is considerate to make phone calls at a time when they will not disturb people. Try not to call too early in the morning (before about 9:00) or too late at night (after about 9:30). Try not to call at mealtime. It's handy to keep a pencil and paper near the phone. If someone calls a member of the family who is not at home, ask the caller if he would Ilk to leave a message. If he does, be sure to get his name and number. 7 if you take a message are sure to remember to deliver it! Table Manners Most families have established their own table manners that are important to them. Here are a few that should be remembered when you are at home and when you are a guest Never reach for any food that is not right in front of you. Ask someone to pass it. If you put something in your mouth that's too hot, don't spit it out. Reach for your water and take a quick swallow. Don't talk with your mouth full. Bring your food up to your mouth rather than bending over to reach it. There are a few additional rules for eating in a restaurant: Don't be upset if you spill something. It happens all the time. The waiter will clean it up. Don't pick up your silverware if you drop it on the floor. Ask the waiter to replace it for you. Don't put packages or handbags on the table. Don't comb your hair at the table. Don't use a toothpick in public. Being a Guest We all know that we have certain responsibilities when we are the host or hostess. But there are responsibilities when one is guests that are equally important. Here are a few of them: Don't go visiting unless you're expected. Don't overstay your invitation. Don't expect to be waited on. Offer to help. Don't plan to stay overnight without consulting the hostess and your parents. Don't upset the family's routine. Try to fit in and (your part. Don't make extra work. Make your bed, straighten up after yourself. Be sure to say thank you for a meal or an overnight visit at a friend's house. Manners on the Street Unless you are at home or at a friend's house, you are on public property. Thermodynamics Laws and Life Essay Introduction The universe is governed by the laws of thermodynamics. In other words, it affects the everyday lives of human beings. Every moment   a man exists, performs his daily activities or interacts with objects around him like every time he walks or drives a car or turn on an air conditioner, or use an electrical appliance, he   reap the practical benefits of thermodynamics (Sonntag 223). According to Sonntag in his book Fundamentals of Physics, â€Å"one excellent definition of thermodynamics is that it is the science of energy and entropy†. Another good definition would be that thermodynamics is the science that deals with heat and work and the properties of substance that bear a relation to heat and work†. As I understand it, thermodynamics had something to with anything that involves the use and transfer heat or energy, and the resulting work it produces. This means that without heat or energy then there would be no work to be performed. And when work is absent then there would be no human existence for life is closely tied with activities. Like all sciences, thermodynamics was established based on experimental observation. Out of this experiments evolved the three laws of thermodynamics (Sonntag 16). The Laws of Thermodynamics First law of Thermodynamics The first law of thermodynamics is often called the Law of Conservation of Energy which states that â€Å"energy cannot be created nor destroyed†. Furthermore, this law suggests that since energy cannot be created or destroyed it is merely transferred from one system to another in many forms. In other words, there is an idea of energy conversion like from heat energy to mechanical energy.   Because energy is not created or destroyed, in the universe as a closed system the amount of energy available is constant (there is no addition or subtraction of energy) . Energy is usually introduced into a system and from thereon undergoes energy transformation to perform some functions(Young 534-536) . In relating to life, a good example would be when a man takes in food (introduction of energy to the body through calorie), heat energy in the form of calorie is transform into chemical energy by his cells which in turn is transform into a mechanical energy so that a man is able to perform physical activities like walking, dancing or talking.   Man by his own self cannot create his own energy (he needs to eat to get energy) and that this energy through bodily processes is transform within his body to enable him to perform some bodily functions. What the first law actually is trying to say is that man just cannot get something out of nothing like he just cannot survive without first eating some amount of food; otherwise he will just fell dead. If only man can create his own energy then he does not need to eat. In the same way, the survival of other living things depend on getting energy from outside sources, for example plants need the energy of the sun for photosynthesis. For objects, in order for it to function, like for a plane in order for it to fly it needs the heat of combustion of its fuel to do work in propelling the plane (Young 534). Second law of Thermodynamics While the first law deals with the conservation of energy, the second law tells of the direction of conservation. In other words, how or where energy transformation normally proceeds. The second law settles the question why when you put ice into a hot cup of tea, heat will flow from the hot tea to the cold ice and melt the ice in the beloved beverage illustrating the unalterable reality that heat cannot be transferred from a colder to a hotter body. It is because natural processes that involve energy transfer must have one direction, and all natural processes are irreversible. That is why, man as human being that makes use of many bodily energy conversions can never go back to being an infant but must proceed to old age.   Or that a machine will go from new to old, it depreciates and lowers in value.   In a sense, the second law puts limitations into how heat conversion is achieved in real life. The second law further states that the direction of thermodynamic processes is more towards from an order to a disorder state or entropy. Entropy is the measure of the disorder or randomness of energy and matter in a system, the higher is a disorder the greater is the entropy. That is why in hot and cold bodies the process proceeds from hot to cold because adding heat to a body increases its disorder because â€Å"it increases average molecular speeds and therefore the randomness of molecular motion†(Young 574).   In other aspects, it is clear now why it is easy to mess up than to clean, and that the greater are the things present the messier it is. According to Young in his book University Physics, in a natural   irreversible isolated system (one that does no work on its surroundings) entropy is always increasing, or the degree of disorder increases with time( Young 541 and579) . This can be illustrated by man getting old. Although some scientific researches had created formulas to make man look younger than his age, this only controls the pace of his getting old, but eventually man had to surrender to the irreversible natural process of body deterioration that will lead to old age and ultimately death. As man increased in age, his body weakens, his cells degenerate and eventually he dies. And when a body decays and die it cannot be renewed again and bring back to life but it will rot on the grave . What the second law of thermodynamics is saying is that there are some things that I cannot control from happening for it is a natural process that needs or must occur and when it did occur it is impossible to undo. This reminds me in some sense of where man is heading in life. He always go towards the future and leaves behind a past. What happened in the past he can never undo for he can never go back to the past. That direction will be forever close to him no matter how much energy he is willing to spend to retraced back to that road. Critics in the biological evolution however, claimed that the theory of evolution violates the second law of thermodynamics, since evolution involves simple life forms developing on their own into more complex, more highly ordered organisms. But living things are not closed systems because they can interact with outside sources of energy like the sun and it has been shown â€Å"that energy and/or mass flow through a system can constrain it far from equilibrium, resulting in an increase in order†.   The organizing ‘work† is then primarily carried on by metabolic motor of DNA, enzymes, etc(  Ã‚  Ã‚  Ã‚  Ã‚   ). Third law of Thermodynamics The third law touches on reaching a state of absolute zero (oK) or to avoid entropy by making temperature equals to zero.   At absolute zero the system has a minimum total internal energy (kinetic plus potential). This however will never occur unless perhaps in few extraordinary, carefully-engineered situations. The third law of thermodynamics reinforced the fact that in life there are things that are unattainable and accepting this reality is a much better idea than to fight the laws of life. Conclusion The laws of thermodynamics just clearly put into much clearer terms the laws of life. Since thermodynamics is a science that deals with energy and energy transformations as well as the resulting work it produces, it has practical applications in life for life is an active use of energy. First law is a conservation of energy which states that energy cannot be created or destroyed meaning that energy is already in existence and needs only to be applied to a system, example a human system, in various forms to benefit life. The second law states that in a natural process there is a direction from which the conservation follows and this is usually to a more disordered state (entropy). Often at such a time I would look towards those panels of black night in the wall which the wooden windows then were, and would fancy that I saw her drawing her face away and would believe that she had come at last. In spite of Estella being so insulting he instantly falls for her, rather for her loo ks. This again shows the immaturity in pip. 2. Generous and sympathetic: pip was generous and sympathetic, a fact that can be seen in his numerous acts of kindness throughout the novel. In page ___ he sympathizes with Magwitch and helps him escape. A small boy going out of his way to help a wretched convict! This goes to show how sympathetic pip was.  Not just sympathetic, pip was large at heart. He was generous. This can be witnessed in page _____ where he secretly buys Herberts way into business. The third example to show that pip was generous is in page 137where he says, as I passed the church I felt a sublime compassion for the poor creatures who were destined to go there, Sunday after Sunday, all their lives thru and to lie obscurely at last among the low green mounds. I promised myself that I would do something for them one of these days and formed a plan in outline for bestowing a dinner of roast beef and plum pudding, a pint of ale and a gallon of condescension upon everybody in the village. 3. Had a great desire for self-improvement: pip always wanted to better himself, better his condition and better his status. This trait in him can be witnessed in page 66 where he tells Joe, and that there had been a beautiful young lady at miss Haveshams who was dreadfully proud and that she had said I was common, and that I wished I was not common, and that the lies had come of it somehow, though I didnt know how. Moreover his deep desire to improve in life, to be Uncommon is also seen in page 68 where he goes to one of his relatives, Biddy to get educated from her. He says, when I woke up the best step I could take towards making myself uncommon was to get out of Biddy everything she knew.  In page 164 he asks Herbert to correct his mannerisms if he found them un-gentlemanly. He says, I further mentioned that as I had been brought up a blacksmith in a country place, and knew very little of the ways of politeness, I would take it is a great kindness in him i.e. Herbert if he would give me a hint when ever he saw me going at a loss or going wrong.
